The purpose of this thesis is to analyse the evolution of legislation and socio-legal interventions in support of the family and minors in separation and divorce situations, with a pedagogical focus on the welfare of the child. In the first chapter, the historical and legislative development of family protection is reconstructed, highlighting how the concept of family has changed over time and how family conflict profoundly affects the growth and serenity of children. Particular attention is devoted to the origin of social services and the central role of schools as agents of educational support in contexts of family crisis. The second chapter is devoted to family mediation, examined as an alternative means of resolving marital conflicts. Legal references, the ESBI model and the main benefits of mediation for children are analysed, as well as a comparison of the different mediation models implemented in Italy and Europe. The third chapter focuses on the professional figures who accompany the child during the separation process: psychologists, psychotherapists, social workers, lawyers, educators and teachers. Each figure is analysed in his or her specific function, highlighting how multidisciplinary work is fundamental for the protection of the child's rights and for fostering his or her harmonious development despite the family break-up. Through an interdisciplinary approach that interweaves law, pedagogy and psychology, the thesis intends to highlight the importance of creating educational and support pathways that put the child's developmental needs at the centre, promoting practices that are not limited to conflict management, but that build real opportunities for growth and resilience.
La presente tesi si propone di analizzare l'evoluzione della normativa e degli interventi socio-giuridici a sostegno della famiglia e dei minori in situazioni di separazione e divorzio, con un focus pedagogico centrato sul benessere del minore. Nel primo capitolo viene ricostruito lo sviluppo storico e legislativo delle tutele familiari, evidenziando come il concetto di famiglia si sia trasformato nel tempo e come il conflitto familiare incida profondamente sulla crescita e sulla serenità dei figli. Particolare attenzione è dedicata all'origine dei servizi sociali e al ruolo centrale della scuola come agente di supporto educativo nei contesti di crisi familiare. Il secondo capitolo è dedicato alla mediazione familiare, esaminata come strumento alternativo di risoluzione dei conflitti coniugali. Si analizzano i riferimenti normativi, il modello ESBI e i principali benefici che la mediazione offre ai minori, nonché una comparazione dei diversi modelli di mediazione attuati in Italia e in Europa. Il terzo capitolo si concentra sulle figure professionali che accompagnano il minore durante il processo di separazione: psicologi, psicoterapeuti, assistenti sociali, avvocati, educatori e insegnanti. Ogni figura è analizzata nella sua funzione specifica, evidenziando come il lavoro multidisciplinare sia fondamentale per la protezione dei diritti del minore e per favorirne uno sviluppo armonioso nonostante la frattura familiare. Attraverso un approccio interdisciplinare che intreccia diritto, pedagogia e psicologia, la tesi intende mettere in luce l’importanza di creare percorsi educativi e di supporto che mettano al centro i bisogni evolutivi del bambino, promuovendo pratiche che non si limitino alla gestione del conflitto, ma che costruiscano reali opportunità di crescita e resilienza.
