IL LEGAME TRA STANDARD LAVORATIVI E QUESTIONE AMBIENTALE: ANALISI DELLA CLAUSOLA SOCIALE E DEGLI STANDARD AMBIENTALI NEL SISTEMA COMMERCIALE MULTILATERALE

This thesis aims to explore the link between labor standards and environmental issues in the context of the multilateral trading system since 1948, with particular attention to the evolution and application of the social clause and environmental standards in the WTO. The main objective of the thesis is to outline and analyze how the multilateral trading system of the GATT/WTO has managed to incorporate and address social and environmental issues within its disciplines, examining the difficulties encountered and the results obtained. To this end, the work focuses on the analysis of two case studies: the first one concerning labor standards and the social clause, and the second one concerning environmental standards. The work is composed of four chapters and the thesis adopts an approach based on the analysis of case studies, primary and secondary sources, including WTO reports, academic literature and scientific articles.

La presente tesi si propone di esplorare il legame tra standard lavorativi e questione ambientale nel contesto del sistema commerciale multilaterale a partire dal 1948, con particolare attenzione all'evoluzione e all'applicazione della clausola sociale e degli standard ambientali nell'OMC. L’obiettivo principale dell'elaborato consiste nel delineare ed analizzare in che modo il sistema commerciale multilaterale del GATT/OMC sia riuscito ad incorporare ed affrontare all’interno delle sue discipline, le questioni sociali ed ambientali, esaminando le difficoltà incontrate ed i risultati ottenuti. A tal fine, il lavoro si focalizza sull’analisi di due casi studio: il primo relativo agli standard lavorativi e alla clausola sociale, ed il secondo sugli standard ambientali. Il lavoro è composto da quattro capitoli e la tesi adotta un approccio basato sull’analisi di casi di studio, fonti primarie e secondarie, tra cui rapporti dell’OMC, letteratura accademica e articoli scientifici.
