This thesis examines proximity contracts, introduced by Article 8 of Decree-Law No. 138 of August 13, 2011, as instruments that allow for the adaptation of labor regulations to specific company or territorial needs by modifying certain provisions established by law or national collective agreements. Following an analysis of the legal framework, the study delves into the conditions necessary for their application and the role of trade unions in the negotiation of such contracts. The thesis also addresses the main challenges, including the risk of diminishing fundamental worker protections. Simultaneously, it considers the opportunities these contracts offer, such as greater flexibility in managing employment relationships and the strengthening of local-level bargaining. To complement the theoretical analysis, the thesis includes an examination of practical cases encountered during professional practice, highlighting how proximity contracts are concretely applied within companies and their effects. Finally, through the analysis of case law and doctrinal contributions, the effectiveness and limitations of this instrument are assessed.
Il presente elaborato affronta il contratto di prossimità che, introdotto dall’art. 8 del D.L. 13 agosto 2011 n. 138, è uno strumento che permette di adattare le regole del lavoro alle specifiche esigenze aziendali o territoriali; modificando alcune norme previste dalla legge o dai contratti collettivi nazionali. Dopo un'analisi del contesto normativo, si approfondiscono le condizioni necessarie per la loro applicazione e il ruolo delle organizzazioni sindacali nella stipula di tali contratti. La tesi inoltre tratta le principali criticità, tra cui il rischio di ridurre le tutele fondamentali dei lavoratori. Allo stesso tempo, vengono considerate le opportunità offerte da questi contratti, come una maggiore flessibilità nella gestione dei rapporti di lavoro e il rafforzamento della contrattazione a livello locale. A completamento, la tesi include l'esame di casi pratici osservati nella pratica, che evidenza come, i contratti di prossimità vengano applicati concretamente nelle aziende e quali siano i loro effetti. Infine, attraverso casi giurisprudenziali e dottrinali, si vedono l'efficacia e i limiti di questo strumento.
