Il trasferimento dei dati dall'UE agli USA

This thesis examines the transfer of personal data between the European Union and the United States, with particular attention to the legal framework governing such flows. After an overview of the privacy protection models adopted in the United States and Europe, the analysis focuses on the “Schrems I” and “Schrems II” cases, which led the Court of Justice of the European Union to invalidate the Safe Harbor and Privacy Shield frameworks, respectively. The study highlights the evolution of transatlantic data transfer agreements, culminating in the recent adoption of the Data Privacy Framework, aimed at ensuring an adequate level of personal data protection in line with European standards.

La presente tesi analizza il trasferimento dei dati personali tra l’Unione Europea e gli Stati Uniti, con particolare attenzione al quadro giuridico che regola tali flussi. Dopo una panoramica sui modelli di tutela della privacy adottati negli Stati Uniti e in Europa, si approfondiscono i casi “Schrems I” e “Schrems II”, che hanno portato all’invalidazione rispettivamente del Safe Harbour e del Privacy Shield da parte della Corte di giustizia dell’UE. L’analisi evidenzia quindi l'evolversi degli accordi tra i due paesi, fino ad arrivare al Data Privacy Framework, recentemente adottato al fine di garantire un livello adeguato di protezione dei dati personali secondo gli standard europei.
