The growing role of Technology has highlighted a double need: on the one hand, the adaptation of legislation and public policies to technological innovation, on the other hand, the development of more flexible regulatory models that can match Progress, without compromising the fundamental principles of the Rule of Law, consolidated over the centuries. In this ceaseless evolving landscape, the experimental legislation emerges as an effective response, providing a transitional tool for a conscious and responsible Innovation. This work focuses on the regulatory sandboxes, analysing how they allow existing normative framework to emerging technologies by enabling the temporary controlled introduction of regulatory exceptions. A pattern which, through a collaborative approach among States, Institutions, businesses and citizens, aspires to guarantee a balance between Innovation and Legality.
Il progressivo ruolo della Tecnologia ha posto in evidenza una duplice esigenza: da un lato, l’adeguamento della legislazione e delle politiche pubbliche alle innovazioni tecnologiche; dall’altro, l’elaborazione di modelli normativi maggiormente flessibili, che accompagnino il Progresso, senza compromettere i principi fondamentali dello Stato di Diritto, sedimentatisi nei secoli. In questo universo in continua evoluzione, la sperimentazione normativa si configura come una risposta efficace, offrendo uno strumento di transizione per un’Innovazione consapevole e responsabile. Il presente lavoro si concentra sull’esperienza delle regulatory sandboxes, analizzando come esse consentano di adattare i quadri normativi esistenti a tecnologie emergenti, permettendo l’introduzione temporanea e controllata di eccezioni normative. Un modello che, tramite un approccio collaborativo tra Stati, istituzioni, imprese e cittadini, ambisce ad essere garanzia di equilibrio tra Innovazione e Legalità.
