The above-mentioned work aims to examine the concept of "sustainability" in the field of agri-food law - a context in which it has become central, despite difficult balances. Sustainability, indeed, being relevant from an environmental, social and economic point of view, requires the law to regulate food chains and promote more just, safe and responsible production and redistribution systems. To illustrate its boundaries, the paper considers three topical issues of interest: nanofood as an example of technological development and the resulting scientific and regulatory challenges; food waste as an ethical, economic and environmental issue, requiring the adoption of systemic approaches; and finally, sustainability arrangements as emerging measures in promoting more sustainable practices by industry.The study is also carried out by comparing different models and/or practices tested in the European context, in particular, with the aim of determining how these legal instruments should be adapted and implemented to start a new path of sustainable growth of agri-food law.
Il suddetto lavoro si prospetta di esaminare il concetto di “sostenibilità” nell’ambito del diritto agroalimentare - contesto in cui è diventato centrale, nonostante i difficili equilibri. La sostenibilità, invero, avendo rilevanza dal punto di vista ambientale, sociale ed economico impone al diritto la regolazione delle filiere alimentari e la promozione di sistemi di produzione e redistribuzione più giusti, sicuri e responsabili. Ed allora, per illustrarne i confini, il lavoro prende in considerazione tre questioni di attualità e interesse: il nanofood, ad esemplificazione dello sviluppo tecnologico e delle conseguenti sfide sul piano scientifico e normativo; lo spreco alimentare, quale tematica etica, economica e ambientale, che impone l’adozione di approcci sistemici; e infine, gli accordi di sostenibilità, come provvedimenti emergenti nella promozione di pratiche maggiormente sostenibili da parte degli operatori del settore. Lo studio è svolto anche attraverso il confronto dei diversi modelli e/o pratiche sperimentate all’interno del contesto europeo, in particolare allo scopo di determinare come tali strumenti giuridici debbano essere adeguati e implementati per avviare un nuovo percorso di crescita sostenibile del diritto agroalimentare.
