This thesis systematically and critically analyzes the reform of sports employment introduced by Legislative Decree no. 36/2021, with a specific focus on the amateur sports sector. The main objective is to investigate the effects of the new legislation on the dilettantistico sector, which represents the backbone of Italian sports and has long been characterized by irregular, fragmented, and poorly protected forms of labor. After reconstructing the historical and regulatory context that led to the adoption of the reform, the thesis focuses on the definition and characteristics of the various roles operating within amateur sports (athletes, coaches, managers, volunteers), distinguishing between subordinate work, self-employment, and coordinated and continuous collaborations, with particular attention to the tax and social security benefits provided for the sector. A full section is devoted to the practical application of the reform, through the analysis of case studies, ministerial documentation, inspection guidelines, and an in-depth reflection on a recent ruling by the Regional Audit Court of Veneto (no. 19/2025), which addresses the compatibility between the “Quota 100” pension scheme and compensation from amateur sports work. The thesis aims not only to provide a comprehensive overview of the current legal framework, but also to highlight the ongoing interpretative and operational issues, proposing ideas for a fairer, more sustainable, and more effective development of the system. The perspective adopted—enriched by the author’s personal experience in the world of amateur sports—seeks to combine legal rigor with practical understanding, offering a useful tool for professionals, consultants, and sports associations.
La presente tesi analizza in modo sistematico e critico la riforma del lavoro sportivo introdotta dal D.Lgs. 36/2021, con un focus specifico sull’ambito dilettantistico. L’obiettivo principale è quello di indagare gli effetti della nuova disciplina sul settore dilettantistico, che costituisce la struttura portante dello sport italiano, e che è stato per decenni caratterizzato da forme di lavoro irregolari, frammentarie e prive di adeguate tutele. Dopo aver ricostruito il contesto storico e normativo che ha portato all’adozione della riforma, il lavoro si concentra sulla definizione e sulle caratteristiche delle diverse figure operanti nel dilettantismo (atleti, tecnici, dirigenti, volontari), distinguendo tra lavoro subordinato, autonomo e forme di collaborazione coordinata e continuativa, con particolare attenzione alle agevolazioni fiscali e previdenziali previste per il settore. Un’intera sezione è dedicata agli aspetti applicativi della riforma, con l’analisi di casi pratici, documentazione ministeriale, indicazioni ispettive e una riflessione approfondita su una recente sentenza della Corte dei Conti del Veneto (n. 19/2025), che tratta la compatibilità tra pensione “Quota 100” e compensi da lavoro sportivo dilettantistico. La tesi si propone non solo di offrire una lettura organica della normativa vigente, ma anche di evidenziare le criticità interpretative e operative tuttora presenti, formulando proposte per un’evoluzione più equa, sostenibile ed efficace del sistema. Il punto di vista adottato, arricchito dall’esperienza personale dell’autore nel mondo dello sport dilettantistico, mira a coniugare rigore giuridico e comprensione pratica, nell’ottica di un lavoro utile a operatori, consulenti e associazioni.
