Tutela del minore a seguito di situazioni a lui pregiudizievoli

The thesis addresses the issue of protecting minors who are victims of harmful situations (with a particular focus on domestic violence and witnessed violence). This work develops the topic starting from the historical and chronological evolution that has led to the recognition of minors as subjects of rights, whose opinions must be considered in matters that concern them. The centrality of shared parenting, a cornerstone of family law, is limited to safeguard the best interests of the minor. The analysis then focuses on Article 403 of the Italian Civil Code, which provides for the prompt intervention of public authorities, followed by judicial authorities. The central part of the thesis examines civil proceedings for the protection of minors, the issuance of temporary, urgent, and indispensable measures, and the resulting decisions. Particular emphasis is placed on the role of the special guardian (curatore speciale) and other figures entrusted with protecting minors, as well as the legal institution of listening to the minor. The thesis concludes with an in-depth analysis of placement options for minors and the paths they can take. Statistical references are provided concerning minors who are victims of domestic violence and witnessed violence, as well as those placed in care. Finally, the thesis reflects on the possibility of preventing removal, the potential of family mediation, and the restoration of parental responsibility.

La tesi tratta il tema della tutela del minore vittima di situazioni a lui pregiudizievoli (concentrandosi in particolare sulla violenza domestica e sulla violenza assistita). Tale elaborato sviluppa l'argomento a partire dall’evoluzione storico-cronologica che ha portato il minore ad essere un soggetto di diritto, ascoltato in relazione alle questioni che lo riguardano. La centralità della bigenitorialità, diritto preso come punto di riferimento nel diritto di famiglia, si contrae al fine di tutelare il minore. Segue l’analisi dell’art.403 c.c. che prevede l’intervento tempestivo dell’autorità pubblica a cui segue quello dell’autorità giudiziaria. La parte centrale dell’elaborato tratta il processo civile a tutela del minore, l’emanazione di provvedimenti temporanei e urgenti e indifferibili, e le decisioni. Si sottolinea il rilievo della figura del curatore speciale e delle ulteriori figure poste a tutela del minore, e dell’istituto dell’ascolto del minore. Si conclude con un approfondimento relativo ai luoghi di collocamento del minore e i percorsi che può intraprendere. Si fanno cenni statistici sui minori vittima di violenza domestica e violenza assistita e dei minori collocati. Infine si riflette sulla possibilità di prevenire l’allontanamento, sulla possibilità della mediazione familiare e del recupero della responsabilità genitoriale.
