The work addresses the issue of external competition in a mafia association, paying particular attention to white-collar crime. Preliminarily, the stages are reconstructed, marked by the sentences of the United Sections, which led to the current configuration of the insolvency case. Subsequently, this discussion focuses on the so-called mafia bourgeoisie, highlighting, primarily, the differences between victim entrepreneurs and colluding entrepreneurs and, secondly, analyzing the so-called. 'grey zone' and its possible overcoming, with entry into the conformation phase. Lastly, by anchoring the analysis to a comparative approach with the other systems and delving into the question of the causal link, we arrive at the prospect of a reformulation of external competition in a mafia association, through the introduction of an autonomous case aimed at fully regulating its structure, with the transition from an event crime to a mixed crime.
L'elaborato affronta la tematica del concorso esterno in associazione mafiosa, dedicando particolare attenzione al crimine dei colletti bianchi, c.d. white-collar crime. Preliminarmente si ricostruiscono le tappe, scandite dalle sentenze delle Sezioni Unite, che hanno portato all'attuale configurazione della fattispecie concorsuale. Successivamente, la presente trattazione si concentra sulla c.d. borghesia mafiosa, evidenziando, primariamente, le differenze tra imprenditori vittime ed imprenditori collusi e, in secondo luogo, analizzando la cd. 'zona grigia' e il suo possibile superamento, con l'ingresso nella fase della conformazione. Da ultimo, ancorando l’analisi a un approccio comparatistico con gli altri ordinamenti e approfondendo la questione del nesso di causalità, si giunge alla prospettiva di una riformulazione del concorso esterno in associazione mafiosa, attraverso l’introduzione di una fattispecie autonoma volta a disciplinarne compiutamente la struttura, con il passaggio da reato di evento a reato misto.
