This paper aims to examine the historical and procedural development of the Roman Inquisition, with particular focus on its operations in Malta during the seventeenth century. The analysis will center on the judicial case involving Sellem Bin Al-Sheikh Mansur, a slave accused of practicing acts of witchcraft against the Catholic population. The study of this trial will allow for the reconstruction of the main phases of the Inquisition's activity within the unique socio-religious context of the island, highlighting how procedural practices could vary depending on the social, cultural, and religious background of the accused. Ultimately, a comprehensive view of the case will provide an opportunity to reflect on the potential legal legacy of the proceedings and to identify any principles and values that emerged during the trial which may still resonate, directly or indirectly, within contemporary procedural dynamics.
Il presente elaborato intende esaminare l’evoluzione storica e procedurale dell’Inquisizione romana, con particolare attenzione per l'Inquisizione nel contesto maltese durante il XVII secolo. L’analisi si concentrerà sul caso giudiziario che vide coinvolto Sellem Bin Al-Sheikh Mansur, uno schiavo accusato di praticare atti di stregoneria nei confronti della popolazione cattolica. Lo studio del procedimento permetterà di ricostruire le principali fasi dell’azione inquisitoriale nel peculiare scenario socio-religioso dell’isola, evidenziando le modalità con cui la prassi processuale potesse adattarsi in funzione della condizione sociale, culturale e religiosa dell’inquisito. In conclusione, una visione complessiva del caso offrirà l’opportunità di riflettere sul possibile lascito giuridico del processo e di individuare eventuali principi e valori affiorati nel contesto giudiziario dell’epoca che trovano corrispondenza, diretta o indiretta, nella dinamica processuale contemporanea.
