TERZO SETTORE E SPORT: QUALE RUOLO PER LE FONDAZIONI? Alla ricerca di un "Tertium genus" nella valorizzazione dell'attività sportiva quale strumento di promozione sociale e inclusività

The Reform of Nonprofits in Italy (Code of the Third Sector) and the reorganization of Amateur Sports Clubs seem to have confirmed the attribution of the task of organizing, managing, training, teaching, preparing and supporting the Amateur Sports only to specific legal forms (associations and social enterprises - ASD and SSD), even though - theoretically- the other Charitable and Nonprofits are not excluded. The recent acknowledgement in the Italian Constitutional Charter of sports activity as fundamental right, due to its educational and social value as well as to its capacity of promoting mental and physical well-being, seems to have expanded the possible audience of actors deputized to its empowerment. This survey aims at verifying - through the analysis of legal framework, case law, administrative practices, and the search for virtuous examples - the opportunity and economic advantage of adding a 'Tertium genus' body (i.e. private Foundations) in empowering sports activity as an instrument of social promotion and inclusiveness.

La riforma del Terzo settore e il riordino degli enti sportivi dilettantistici sembrano aver confermato l’attribuzione a specifiche forme giuridiche (associazioni e imprese sociali; associazioni e società sportive) l’attribuzione dei compiti di organizzazione, gestione, formazione, didattica, preparazione e assistenza dello sport dilettantistico. La costituzionalizzazione dell’attività sportiva, affermandone il valore educativo, sociale e di promozione del benessere psicofisico sembra invece aver ampliato la possibile platea di attori deputati alla sua promozione. Il presente lavoro si propone di verificare, attraverso lo studio delle fonti normative, giurisprudenziali, di prassi, e la ricerca di esempi virtuosi, la possibilità e la convenienza economica di aggiungere nella valorizzazione dell’attività sportiva in senso costituzionalmente orientato un ‘Tertium genus’ - le fondazioni - quale specifica forma giuridica, più flessibile ed efficace, di promozione sociale e inclusività.
