This thesis examines the offence of kidnapping for the purpose of extortion, as set forth in Article 630 of the Italian Criminal Code, beginning with a preliminary analysis of the general offence of kidnapping under Article 605 c.p., in order to highlight the structural, functional, and punitive differences between the two provisions. After outlining the essential features of both offences, the work focuses on key interpretative and legal issues, with particular attention to constitutional legitimacy and procedural aspects that have sparked debate in both legal scholarship and case law. The thesis concludes with a narrative analysis of a real case: the kidnapping of Carlo Celadon. Through the account of this case, the study offers a reflection on the practical application of Article 630 c.p. and on the evolution of judicial responses to one of the most serious forms of personal liberty deprivation.
La presente tesi analizza la fattispecie del sequestro a scopo di estorsione, disciplinata dall’art. 630 del codice penale, muovendo da una preliminare ricognizione del reato di sequestro di persona ex art. 605 c.p. al fine di evidenziarne differenze strutturali, funzionali e sanzionatorie. Dopo aver delineato i tratti essenziali di entrambe le fattispecie, l’elaborato si concentra su alcune questioni interpretative e giuridiche, con particolare attenzione ai profili di legittimità costituzionale e agli aspetti processuali che hanno sollevato dibattito in dottrina e giurisprudenza. Infine la tesi si conclude con la narrazione di un caso concreto: il sequestro di Carlo Celadon, dove , attraverso il racconto della vicenda, si offre uno spunto di riflessione sull’applicazione concreta dell’art. 630 c.p. e sull’evoluzione della risposta giudiziaria a una delle forme più gravi di privazione della libertà personale.
