This thesis explores the complex relationship between the use of social media and the employment relationship, with particular attention to the legal limits imposed on the employer's power of control. It examines new forms of digital monitoring, which complement traditional methods of supervision, as well as the implications arising from the use of technological tools in the workplace. Special focus is placed on the prohibition of unlawful investigations into employees' personal profiles, the regulatory framework on privacy protection, and the employer's disciplinary power, with specific reference to the analysis of dismissals related to conduct on social media. The objective is to access what might constitute a reasonable balance between corporate control needs and the fundamental rights of employees. Through the analysis of recent case law and both national and international regulations, the thesis offers a critical reflection on the challenges posed by digitalization in the world of work.
La presente tesi analizza il complesso rapporto tra l'utilizzo dei social media e il rapporto di lavoro, con particolare attenzione ai limiti giuridici imposti al potere di controllo del datore di lavoro. Vengono esaminate le nuove forme di controllo digitale, che si affiancano alle tradizionali modalità di vigilanza, e le implicazioni derivanti dall'uso di strumenti tecnologici nell'ambiente lavorativo. Un focus specifico è riservato al divieto di indagini illegittime sui profili personali dei lavoratori e alla disciplina vigente in materia di tutela della privacy e al potere disciplinare, con particolare riferimento all'analisi dei licenziamenti per condotte tenute sui social media. L'obiettivo è quello di valutare quale possa essere il più ragionevole bilanciamento tra esigenze di controllo aziendale e diritti fondamentali dei dipendenti. Attraverso l'analisi della giurisprudenza recente e delle normative nazionali e internazionali, la tesi propone una riflessione critica sulle sfide poste dalla digitalizzazione nel mondo del lavoro.
