The thesis addresses the complex intersection between the right to life, abortion, and human rights, focusing on the U.S. context following the landmark Supreme Court decision Dobbs v. Jackson (2022). Starting from an analysis of General Comment No. 36 of the United Nations Human Rights Committee—which interprets Article 6 of the ICCPR on the right to life—the paper examines how this document acknowledges the need for safe and legal access to abortion in order to protect women's fundamental rights, including life and health. The research focuses on the consequences of the abolition of the federal right to abortion in the United States and the different policies adopted by individual states, analyzing potential legislative regressions in some areas and attempts at protection in others. The objective is to critically reflect on the relationship between the right to life and the right to abortion in the American context, in light of international human rights standards.
La tesi affronta la complessa intersezione tra diritto alla vita, aborto e diritti umani, concentrandosi sul contesto statunitense dopo la storica sentenza Dobbs v. Jackson (2022). A partire dall'analisi del General Comment n.36 del Comitato per i Diritti Umani delle Nazioni Unite - che interpreta l'articolo 6 dell'ICCPR sul diritto alla vita - si esamina come tale documento riconosca la necessità di accesso sicuro e legale all'aborto per tutelare i diritti fondamentali delle donne, inclusa la vita e la salute. La ricerca si concentra sulle conseguenze dell'abolizione del diritto federale all'aborto negli Stati Uniti e sulle differenti politiche adottate dai singoli Stati, analizzando eventuali regressioni legislative in alcune aree ed eventuali tentativi di tutela in altre. L'obiettivo è quello di analizzare il contesto americano riflettendo criticamente sul rapporto tra diritto alla vita e diritto all’aborto, alla luce degli standard internazionali in materia di diritti umani.
