This thesis explores the role of businesses in the climate crisis, focusing on the concept of climate due diligence and its connection to human rights. The first chapter outlines the international legal framework, from the UN Guiding Principles on Business and Human Rights to the latest European directives on corporate due diligence. The second chapter examines how traditional human rights due diligence is evolving to include climate-related risks. The third chapter looks at corporate responses, highlighting both positive examples (such as Patagonia) and companies that have not yet adopted concrete climate strategies. The aim is to understand whether and how businesses can contribute responsibly to the ecological transition and the protection of fundamental rights.
La tesi analizza il ruolo delle imprese nella crisi climatica, concentrandosi sul concetto di climate due diligence e sul suo legame con i diritti umani. Nel primo capitolo viene presentato il quadro normativo internazionale, dai Principi Guida ONU fino alle nuove direttive europee sulla due diligence. Il secondo capitolo approfondisce come la due diligence sui diritti umani si stia evolvendo per includere anche i rischi legati al cambiamento climatico. Il terzo capitolo analizza le risposte delle imprese: da quelle considerate virtuose, come Patagonia, ad altre che non hanno ancora adottato strategie concrete. L’obiettivo è capire se e come le imprese possano contribuire in modo responsabile alla transizione ecologica e alla tutela dei diritti fondamentali.
