This thesis analyzes the decree-law as a political and legal instrument during the transitional phase between the First and Second Italian Republics, with particular attention to the “Biondi Decree” of 1994. The analysis is contextualized within the institutional crisis triggered by Tangentopoli and the “Mani Pulite” investigation, which led to the collapse of traditional political parties and the emergence of new political movements. Through a legal and political analysis of the decree-law, the thesis aims to demonstrate how the use of emergency legislation can become a powerful tool of interference in the relations between branches of the State. Following a reconstruction of the historical and political context of Italy between 1992 and 1994, the work focuses on the decree introduced by Minister Alfredo Biondi, which sought to limit pre-trial detention for crimes against public administration. The research focuses on the opposition to this decree, which was interpreted as an attempt to obstruct ongoing judicial investigations. Using official sources, contemporary press, interviews, and legal-political literature, the thesis reflects on the significance of the Biondi Decree as a symbol of a broader strategy aimed at redefining the balance of powers in the emerging Second Republic, raising questions about the boundary between the legitimate exercise of executive power and its illegitimate use for political purposes, also nowdays.
La presente tesi analizza il decreto-legge come strumento politico e giuridico nella fase di transizione tra la Prima e la Seconda Repubblica italiana, con particolare attenzione al “decreto Biondi” del 1994. L’analisi è contestualizzata durante la crisi istituzionale generata da Tangentopoli e dall’inchiesta “Mani Pulite”, che portarono al crollo dei partiti tradizionali e all’emergere di nuove formazioni politiche. Attraverso l’analisi normativa e politica del decreto-legge, la tesi si propone di mostrare come l’uso della decretazione d’urgenza possa diventare un potente strumento di interferenza nei rapporti tra poteri dello Stato. Dopo una ricostruzione del quadro storico-politico dell’Italia tra il 1992 e il 1994, l’elaborato si concentra sul decreto presentato dal ministro Alfredo Biondi, volto a limitare la custodia cautelare per i reati contro la pubblica amministrazione. La ricerca si concentra sull’opposizione a questo decreto, interpretato come un tentativo di ostacolare le indagini giudiziarie in corso. Attraverso fonti ufficiali, stampa dell’epoca, interviste e letteratura giuridico-politica, la tesi riflette sul significato del decreto Biondi come simbolo di una strategia più ampia di ridefinizione dei rapporti tra poteri nella nascente Seconda Repubblica, ponendo interrogativi sul confine tra il legittimo esercizio del potere esecutivo e il suo uso illegittimo per scopi politici, anche ad oggi.
