Contemporary armed conflicts, increasingly prolonged, urbanized, and complex, continue to disproportionately affect individuals in conditions of vulnerability. Among them, children represent one of the most exposed groups, as they are victims of serious violations that compromise their physical, psychological, social, and educational development. Although the protection of childhood is widely recognized under international law, in the reality of armed conflict these guarantees are often ineffective or not enforced. In this context, the law emerges both as a tool for response and prevention, and as a field where structural limitations become evident. The purpose of this thesis is to examine how international human rights law addresses the vulnerability of children affected by war, by reconstructing the legal framework, analyzing the consequences of conflict, and exploring current protection perspectives.
I conflitti armati contemporanei, sempre più prolungati, urbanizzati e complessi, continuano a colpire in modo sproporzionato le persone in condizioni di vulnerabilità. Tra queste, i bambini rappresentano una delle categorie più esposte, vittime di gravi violazioni che compromettono il loro sviluppo fisico, psicologico, sociale ed educativo. Sebbene la tutela dell’infanzia sia ampiamente riconosciuta dal diritto internazionale, nella realtà dei contesti bellici tali garanzie risultano spesso inapplicate o inefficaci. In questo scenario, il diritto emerge come strumento di risposta e prevenzione, ma anche come ambito in cui si manifestano limiti strutturali. Lo scopo del presente elaborato è analizzare in che modo il diritto internazionale dei diritti umani affronti la vulnerabilità dei bambini vittime di guerra, ricostruendo il quadro giuridico, le conseguenze dei conflitti e le prospettive di protezione.
