This thesis addresses the issue of administrative silence, understood as the failure of public authorities to adopt a decision within the legally prescribed time limits. The analysis focuses on the legal consequences of such inertia for private individuals and on the remedies provided by the legal system. By examining the current legislative framework and relevant case law, the study highlights existing critical issues and explores possible reforms, with the aim of promoting a more efficient public administration that fully respects the rights of individuals.
La tesi affronta il tema del silenzio della pubblica amministrazione, inteso come mancata adozione di un provvedimento entro i termini previsti. L’analisi si concentra sugli effetti che tale inerzia produce nei confronti del cittadino e sugli strumenti giuridici di tutela previsti dall’ordinamento. Attraverso l’esame della normativa vigente e dell’evoluzione giurisprudenziale, il lavoro evidenzia le criticità attuali e le prospettive di riforma, con l’obiettivo di garantire un’amministrazione più efficiente e rispettosa dei diritti del privato.
