Originally, the Italian administrative system was characterised by an authoritarian conception of administrative action and fragmented legislation. Law No. 241 of 1990 represented a significant turning point, introducing in general way the right of interested parties to participate in the administrative procedure. The thesis analyzes the role of the notice initiating proceedings as a tool to ensure transparency, participation and protection of citizens' interest in relation to the action of public administration. The paper also elaborates on the communication of the reasons for the acceptance of the application, known as prior notice of rejection, of which it reconstructs the evolution of the legislation and the main critical interpretations. Overall, the thesis aims to demonstrate how the institutions of initiating communication and prior notice of rejection are essential for making administrative action more open, collaborative and balanced in the relationship between citizen and public administration.
In origine, il sistema amministrativo italiano era caratterizzato da una concezione autoritaria dell’azione amministrativa e da una normativa frammentata. La legge n. 241 del 1990 ha rappresentato un punto di svolta significativo, introducendo in via generale il diritto degli interessati a partecipare al procedimento amministrativo. La tesi analizza il ruolo della comunicazione di avvio del procedimento come strumento per garantire trasparenza, partecipazione e tutela dell’interesse dei cittadini nei confronti dell’azione della pubblica amministrazione. L’elaborato approfondisce anche la comunicazione dei motivi ostativi all’accoglimento dell’istanza, noto come preavviso di rigetto, di cui ricostruisce l’evoluzione normativa e le principali criticità interpretative. Nel complesso la tesi intende dimostrare come gli istituti della comunicazione di avvio e del preavviso di rigetto siano essenziali per rendere l’azione amministrativa più aperta, collaborativa ed equilibrata nel rapporto tra cittadino e pubblica amministrazione.
