The principle of self-determination of peoples is one of the most complex and debated issues in contemporary international law. It lies at the intersection of state sovereignty, customary normativity, and the geopolitical dynamics that shape the international order. Its legal status has undergone significant evolution, moving from a narrow conception linked to decolonization processes to a broader application in contexts of state dissolution, internal conflicts, and claims for independence. 1 The case of Kosovo represents an emblematic paradigm of the tensions between self-determination and territorial integrity, highlighting the challenges that emerge in its implementation in international legal practice. 2 The aim of this research is to offer a critical examination of the legal and philosophical implications of the right to self-determination in the Kosovar context, with particular attention to the 2010 decision of the International Court of Justice (ICJ) and its impact on legal doctrine and state practice. 3 Through an interdisciplinary methodological approach integrating normative, jurisprudential, and historical-political analysis, the research will examine the theoretical foundations of self-determination, the dialectic between internal and external self-determination, and the systemic repercussions of the Kosovar secession on international law. Particular attention will be paid to the philosophical-legal dimension of the principle, exploring its controversial nature and its constant redefinition in response to changing geopolitical conditions and new emerging paradigms in international law.
Il principio di autodeterminazione dei popoli costituisce una delle tematiche più complesse e dibattute all’interno del diritto internazionale contemporaneo. Esso si colloca all’incrocio tra la sovranità statuale, la normatività consuetudinaria e le dinamiche geopolitiche che plasmano l’ordine internazionale. Il suo statuto giuridico ha subito un’evoluzione significativa, passando da una concezione ristretta legata ai processi di decolonizzazione a un’applicazione più ampia in contesti di dissoluzione statuale, conflitti interni e rivendicazioni di indipendenza1 . Il caso del Kosovo rappresenta un paradigma emblematico delle tensioni tra autodeterminazione e integrità territoriale, mettendo in luce le sfide che emergono nella sua implementazione nella prassi giuridica internazionale2. L’obiettivo della presente ricerca è offrire una disamina critica delle implicazioni giuridico-filosofiche del diritto all’autodeterminazione nel contesto kosovaro, con particolare attenzione alla decisione della Corte Internazionale di Giustizia (CIJ) del 2010 e al suo impatto sulla dottrina giuridica e sulla prassi statuale3 . Attraverso un approccio metodologico interdisciplinare, che integra analisi normativa, giurisprudenziale e storico-politica, la ricerca esaminerà le fondamenta teoriche dell’autodeterminazione, la dialettica tra autodeterminazione interna ed esterna e le ripercussioni sistemiche della secessione kosovara sul diritto internazionale. Un’attenzione particolare sarà dedicata alla dimensione filosofico-giuridica del principio, esplorando la sua natura controversa e la sua costante ridefinizione in funzione delle mutevoli condizioni geopolitiche e dei nuovi paradigmi emergenti nel diritto internazionale.
