This thesis delves into the role of Legal Design in the protection of personal data, with particular attention to the use of dark patterns in digital interfaces by online platforms. Following a theoretical and regulatory overview of data protection in light of the GDPR, the paper analyzes how manipulative practices can undermine users’ informed consent. Through an in-depth analysis of the Meta case (Facebook and Instagram), it highlights critical issues related to the use of dark patterns to influence users’ choices regarding the sharing of their personal data. The thesis concludes by proposing solutions inspired by the principles of Legal Design, aimed at making digital interfaces more transparent, ethical, and legally compliant. The objective is to demonstrate how the Legal Design approach can concretely contribute to greater digital awareness and empowerment for users.
La presente tesi approfondisce il ruolo del Legal Design nella tutela dei dati personali, con particolare attenzione all’uso dei dark patterns nelle interfacce digitali da parte delle piattaforme.Dopo un inquadramento teorico e normativo sulla protezione dei dati alla luce del GDPR, l’elaborato analizza come pratiche manipolative possano compromettere il consenso informato degli utenti. Attraverso un’analisi approfondita del caso Meta (Facebook,Instagram), si evidenziano criticità legate all’uso di dark patterns per influenzare le scelte degli utenti in merito alla condivisione dei propri dati. La tesi propone infine soluzioni ispirate ai principi del Legal Design, volte a rendere le interfacce digitali più trasparenti, etiche e conformi alla normativa. L’obiettivo è dimostrare come l’approccio del Legal Design possa contribuire concretamente a una maggiore consapevolezza digitale da parte degli utenti.
