Sicurezza sul lavoro oltre confine: dalla Valutazione dei Rischi Generici Aggravati alla Travel Security aziendale. Il caso di una holding metalmeccanica

In the global economy, offshoring, i.e. the relocation of a part or all the production process to foreign countries, is becoming increasingly widespread and common. Alongside the advantages and opportunities offered by these corporate choices is the issue of the health and safety of workers who travel abroad. Travel security is often an issue that is underestimated and neglected by companies, whereas in the current context, characterized by new emerging risks, it has become a topic that requires careful attention and assessment. According to the Italian Legislative Decree 81/2008, employers are required to assess all risks, including the so-called “aggravated generic risks,” i.e., those risks that, although common to all individuals, are aggravated for certain categories of workers, transforming them into occupational risks worthy of protection. These include risks related to the geographical and climate characteristics of the country in which the work is carried out, the general health conditions, the local cultural, political, and social conditions, the risks of war or secession, and the adequacy of emergency and first aid support structures. The assessment of these risks must be developed considering not abstract risks, but those that have a reasonable and concrete possibility of occurring in relation to the work carried out and the characteristics of the host country. Considering the regulatory gap between Italy and the EU on this issue and starting from a case study of a holding company operating in the metalworking sector, the aim of this study is to design, draft, and propose a series of tools useful to a company with production sites in foreign countries for developing its own Travel Security System. Central in this thesis will be the drafting of the Specific Risk Assessment document and the information, training and empowerment of all company stakeholders involved.

Nell’ambito dell’economia mondiale, il fenomeno dell’offshoring, ovvero la delocalizzazione di una parte o dell’intero processo produttivo in Paesi esteri, è sempre più diffuso e comune. Ai vantaggi e alle opportunità che si presentano da queste scelte aziendali, si affianca la tematica della salute e sicurezza dei lavoratori che si recano oltre confine. Quella della Travel Security risulta molto spesso essere una materia sottovalutata e trascurata dalle aziende, mentre nel contesto attuale caratterizzato da nuovi rischi emergenti, diventa invece un tema da attenzionare e valutare accuratamente. Ai sensi del D.Lgs 81/2008, è obbligo del datore di lavoro valutare tutti i rischi, inclusi i cosiddetti “rischi generici aggravati”, ovvero quei rischi che pur essendo comuni a tutti i soggetti, si aggravano per alcune categorie di lavoratori trasformandosi in rischi lavorativi meritevoli di tutela. Tra questi vi sono i rischi concernenti le caratteristiche geografiche e climatiche del Paese in cui si svolge la prestazione lavorativa, le condizioni sanitarie, le caratteristiche culturali, politiche e sociali della comunità, il rischio di guerre o secessioni e l’adeguatezza delle strutture di supporto per l’emergenza e il pronto soccorso. La valutazione di questi rischi deve essere svolta considerando non rischi astratti, ma che abbiano la ragionevole e concreta possibilità di manifestarsi in correlazione all’attività lavorativa svolta e alle caratteristiche del Paese ospitante. Considerando il gap normativo italiano e comunitario rispetto a questa tematica e partendo dal caso studio di una holding operante nel settore metalmeccanico, lo scopo del presente studio è quello di progettare, redigere e proporre una serie di strumenti utili ad una azienda con sedi produttive in Paesi esteri per sviluppare un proprio sistema di Travel Security. Centrali saranno dunque la redazione del Documento di valutazione del rischio specifico, e l’informazione, formazione e responsabilizzazione di tutti gli attori aziendali coinvolti.
