This thesis takes as its starting point an analysis of the 2025 Security Package and its provisions on telecommunications, with particular attention to the consequences for migrants lacking regular documentation. Through a comparison with scholarly articles, specialist journals, and academic sources, the study highlights how these rules have contributed to forms of regulatory discrimination and to phenomena of digital exclusion. The investigation adopts a multidisciplinary approach that connects the Italian case to the concepts of discrimination, security, and migration policy, in order to critically interrogate the tension between individual liberty, public-order needs, and the protection of human rights. In particular, it explores the role of access to telecommunications as a fundamental human right and an essential condition for the exercise of civil, political, and social rights. The aim of the research is to show how a security-oriented approach that is not properly balanced risks undermining fundamental principles of the rule of law, making a broader reflection necessary on the compatibility between security policies and the effective guarantee of the rights of the most vulnerable
La tesi prende avvio dall’analisi del Pacchetto Sicurezza del 2025 e delle sue disposizioni in materia di telecomunicazioni, con particolare attenzione alle conseguenze per i migranti privi di documentazione regolare. Attraverso il confronto con articoli scientifici, riviste specializzate e fonti accademiche, il lavoro evidenzia come tali norme abbiano contribuito a forme di discriminazione normativa e a fenomeni di esclusione digitale. L’indagine si sviluppa secondo un approccio multidisciplinare, che collega il caso italiano ai concetti di discriminazione, sicurezza e politiche migratorie, per interrogare criticamente la tensione tra libertà individuale, esigenze di ordine pubblico e tutela dei diritti umani. In particolare, viene approfondito il ruolo dell’accesso alle telecomunicazioni come diritto umano fondamentale e condizione essenziale per l’esercizio di diritti civili, politici e sociali. L’obiettivo della ricerca è mostrare come un approccio securitario non adeguatamente bilanciato rischi di minare principi fondamentali dello Stato di diritto, rendendo necessaria una riflessione più ampia sulla compatibilità tra politiche di sicurezza e garanzia effettiva dei diritti delle persone più vulnerabili.
