The thesis explores the problem of obedience to unjust law as a core issue in legal and political philosophy, viewing disobedience “in the name of law” as an act of loyalty to justice rather than rejection of legality. Through the comparison between Henry David Thoreau and Hannah Arendt, it shows how civil disobedience embodies both moral and political responsibility: for Thoreau it arises from individual conscience, while for Arendt it becomes collective action and a foundation of democracy. Disobedience thus emerges as a means of renewing the law and preserving its legitimacy.
La tesi analizza il problema dell’obbedienza alla legge ingiusta come questione centrale della filosofia del diritto, interpretando la disobbedienza “in nome del diritto” come atto di fedeltà alla giustizia e non di negazione dell’ordine legale. Attraverso il confronto tra Henry David Thoreau e Hannah Arendt, il lavoro mostra come la disobbedienza civile possa rappresentare una forma di responsabilità morale e politica: in Thoreau è espressione della coscienza individuale, in Arendt diventa azione collettiva e fondamento della democrazia. La disobbedienza è così intesa come strumento di rigenerazione del diritto e garanzia della sua legittimità.
