Deforestation represents one of the main causes of climate change, contributing to the increase of greenhouse gases in the atmosphere, the loss of biodiversity, and soil degradation. To address this issue, both the United Nations and the European Union have adopted numerous mechanisms, conventions, and legal instruments, including the Regulation on Deforestation-free Products 2023/1115 (EUDR). After reconstructing the main international instruments for environmental protection, the thesis examines the development of EU environmental law and policy leading to the adoption of the EUDR. In particular, it explores the regulatory structure of the Regulation, the due diligence mechanism, and the economic, social, and environmental implications of its implementation for the European Union and third countries. Through a comparative and interdisciplinary approach, the thesis ultimately reflects on the role of law in promoting sustainable development models capable of reconciling environmental protection, international trade, and global justice.
La deforestazione rappresenta una delle principali cause del cambiamento climatico, responsabile dell'aumento dei gas serra nell'atmosfera, della perdità di biodiversità e della degradazione del suolo. Per porvi rimedio, sia le Nazioni Unite sia l'Unione europea hanno adottato numerosi meccanismi, convenzioni e normative, tra cui il Regolamento sui prodotti a deforestazione zero 2023/1115 (EUDR). Dopo una ricostruzione dei principali strumenti internazionali di protezione ambientale, la tesi esamina lo sviluppo delle politiche e del diritto dell’UE, fino all’adozione dell'EUDR. In particolare si approfondisce la struttura normativa del Regolamento, il meccanismo di due diligence e le conseguenze economiche, sociali e ambientali della sua attuazione per l’Unione e per i paesi terzi. Attraverso un approccio comparato e interdisciplinare, la tesi riflette infine sul ruolo del diritto nella promozione di modelli di sviluppo sostenibile capaci di conciliare tutela ambientale, commercio internazionale e giustizia globale.
