Nowadays, urbanisation, increasing vehicle traffic, and the growth of industrial activities have made air pollution a new challenge for the European Union, with significant consequences for people's quality of life and, more generally, for the global climate. Faced with this situation, the European Union has embarked on a process of regulatory review, also in light of the European Green Deal. This thesis analyses the state of the art of European environmental law, with a particular focus on air quality legislation. The thesis is divided into four chapters. The first and second chapters provide an overview of the evolution of environmental law in the European context, from the Treaty of Rome to the European Green Deal, with a focus on the role of the European Environment Agency. The third chapter offers a more detailed analysis of the new European Directive 2024/2881 on air quality. Finally, the fourth chapter deals with Italy's approach to adapting to the European directive.
Nella nostra contemporaneità l’urbanizzazione, il crescente traffico veicolare e l’aumento delle attività industriali hanno reso l’inquinamento atmosferico una nuova sfida per l’Unione Europea con conseguenze rilevanti sulla qualità di vita delle persone e, più in generale, sul clima globale. Di fronte a questa condizione l’Unione Europea ha intrapreso un percorso di revisione normativa, alla luce anche del Green Deal Europeo. Il presente elaborato di tesi si occupa di analizzare lo stato dell'arte del diritto ambientale europeo con particolare attenzione alla normativa sulla qualità dell'aria. La tesi si articola in quattro capitoli. Il primo e secondo capitolo offrono una panoramica sull’evoluzione del diritto ambientale nel contesto europeo, dal Trattato di Roma al Green Deal Europeo, soffermandosi sul ruolo dell’Agenzia Europea dell’Ambiente. Il terzo capitolo offre un’analisi più dettagliata della nuova Direttiva europea 2024/2881 sulla qualità dell’aria. Infine, il quarto capitolo tratta l’approccio dell’Italia in materia di adattamento alla direttiva europea.
