The thesis aims to examine the new simplified procedure of cognition, introduced by the legislator within the broader reform of civil procedure enacted through Legislative Decree No. 149 of 2022, inspired by goals of efficiency and rationalization. In order to fully appreciate the scope and rationale of the reform, the analysis begins with the preceding regulatory framework, with particular reference to the rito sommario established in 2009, regarded as the precursor of the current simplified model and marked by both strengths and weaknesses in its practical application. The study then turns to the new simplified procedure, analyzing its normative structure and the problematic aspects that have generated a lively scholarly debate. Certain difficulties encountered in practice have led the legislator to revise the discipline, culminating in the enactment of Legislative Decree No. 164 of 2024, whose amendments are also examined. Particular attention is devoted to the question of whether increased procedural flexibility—often presented as a tool of modernization—may, in fact, result in a contraction of the guarantees of due process “regulated by law,” thereby creating potential tensions with the constitutional principle enshrined in Article 111. A significant part of the research is dedicated to the concept of case management, investigated both in its theoretical foundations and in its practical instruments, with consideration of the various forms it has assumed in foreign legal systems. From a comparative perspective, the study reflects on the possibility of adapting such models within the Italian context, traditionally characterized by procedural rigidity but increasingly called upon to align with a European legal landscape oriented toward greater flexibility and proportionality.
La tesi si propone di esaminare il nuovo procedimento semplificato di cognizione, introdotto dal legislatore nell’ambito del più ampio progetto di riforma del processo civile attuato con il d.lgs. 149 del 2022, ispirato a finalità di efficienza e razionalizzazione. Al fine di cogliere appieno la portata e lo spirito della riforma, l’analisi prende avvio dalla disciplina previgente, con particolare riferimento al rito sommario delineato nel 2009, considerato l’antenato dell’attuale modello semplificato e caratterizzato da luci ed ombre che ne hanno segnato l’applicazione. Successivamente, l’elaborato si concentra sul nuovo procedimento semplificato, esaminandone la disciplina e i profili problematici che hanno dato luogo a un vivace dibattito dottrinale. Talune problematiche sorte in sede applicativa hanno portato il legislatore a rivedere la disciplina, emanando il d.lgs. 164 del 2024, le cui modifiche vengono analizzate. Ci si è posti l’interrogativo se la maggiore flessibilità procedurale, spesso vista come strumento di modernizzazione, possa tradursi in una compressione delle garanzie del giusto processo “regolato dalla legge”, con possibili frizioni rispetto al dettato costituzionale dell’art. 111. Pdel lavoro è dedicata al tema del case management, indagato tanto nei suoi aspetti teorici e pratici, con attenzione alle diverse declinazioni che esso ha assunto negli ordinamenti stranieri. In chiave comparatistica, si propone una riflessione sulla possibilità di adattare tali modelli nel contesto italiano, caratterizzato da una tradizionale rigidità procedurale, ma chiamato sempre più a confrontarsi con un panorama europeo improntato a maggiore elasticità e proporzionalità.
