La legislazione antiterrorismo in Francia e in Italia.

The thesis analyzes the phenomenon of terrorism through a comparative legal perspective between France and Italy, retracing the historical evolution of the notion and the normative framework that governs it. It critically examines the two legal systems, the offences they establish, the applicable penalties. Throughout the study, attention is devoted to the doctrinal influences and legislative reforms that have progressively shaped anti-terrorism law. The aim is to provide a comparative and critical reading of a complex field, intrinsically protean in nature and in constant transformation as events evolve.

La tesi analizza il fenomeno del terrorismo attraverso una prospettiva giuridica comparata tra Francia e Italia, ricostruendo l’evoluzione storica della nozione e l’elaborazione normativa che lo disciplina. Essa esamina criticamente i due regimi giuridici, le incriminazioni previste, le pene applicabili poi l’istituto del pentitismo. L’attenzione è rivolta, lungo tutto lo sviluppo, alle influenze dottrinali e alle riforme legislative che hanno progressivamente modellato il diritto antiterrorismo. L’obiettivo è offrire una lettura comparata e critica di una materia complessa perché intrinsecamente multiforma e in continua trasformazione al mutare degli eventi.
