This paper analyses the non-possessory pledge guarantee in bank financing for businesses, with the aim of assessing its potential impact on the relationship between banks and businesses, with a view to revitalising the commercial sector and consequently stimulating economic growth. Through an analysis of the evolution of legislation, doctrine and case law, the work highlights the dynamism of this new type of pledge, the uncertainties in identifying the asset to which it relates , the gaps in legislation and the consequent application issues.
Il presente elaborato analizza la garanzia di pegno non possessorio nei finanziamenti bancari alle imprese con l'obbiettivo di vagliarne la capacità di incisione nel rapporto banca-impresa, ai fini di una rivitalizzazione del settore commerciale e una consequenziale ripresa economica. Attraverso l'evoluzione normativa, la dottrina e la giurisprudenza il lavoro evidenzia la dinamicità del nuovo sotto-tipo di pegno, la mutevole perimetrazione dell'istituto, le lacune normative e le consequenziali criticità applicative.
