This thesis analyzes the legal philosophy of Gustav Radbruch, with particular attention to the relationship between legality and justice and his "formula". After reconstructing the theoretical foundations of his philosophy of law, rooted in Neo-Kantianism and based on the justice–utility–certainty triad, the work examines Radbruch’s post-war rethinking, and the critique of the limits of legal positivism in light of theexperience of Nazism. In this perspective, the thesis explores civil disobedience as a response to unjust laws, focusing on the case of Carola Rackete and the Sea-Watch 3. The aim is to highlight the relevance of Radbruch’s thought in contemporary discourses on the rule of law and on obedience to the law.
L'elaborato esplora il pensiero giusfilosofico di Gustav Radbruch, ponendo particolare attenzione al rapporto legalità-giustizia e alla sua celebre "formula". Dopo aver ricostruito i fondamenti teorici della sua filosofia del diritto, radicata nel neokantismo e basata sulla triade giustizia–utilità–certezza, il lavoro esamina la rilettura operata da Radbruch nel secondo dopoguerra, e la denuncia dei limiti del giuspositivismo di fronte all’esperienza del nazismo. In questa prospettiva, si approfondisce il tema della disobbedienza civile come risposta all’ingiustizia legale, prendendo come caso di studio l’azione di Carola Rackete con la nave Sea-Watch 3. L’elaborato si propone di mostrare l’attualità del pensiero radbruchiano nella riflessione contemporanea sullo Stato di diritto e sull’obbedienza alla legge.
