The eradication of poverty constitutes one of the most urgent and complex challenges that the international community is called upon to address. Far from being a merely economic issue, poverty must be understood as a phenomenon intrinsically linked to the protection of human rights. Accordingly, this paper seeks to analyse poverty in light of the legal framework developed within the United Nations system, with the aim of understanding to what extent the issue can be interpreted from a legal perspective. Through an examination of the International Covenant on Economic, Social and Cultural Rights and other key documents produced by the Organization, the study aims to investigate the progressive affirmation of the idea that poverty represents a form of denial or non-fulfilment of human rights. The analysis will also consider the theoretical questions raised by this approach: to what extent is it appropriate to qualify poverty as a violation of human rights? Are all rights equally relevant for such a qualification, or do only certain categories play a decisive role, and according to which criteria? After outlining the historical evolution of poverty as a social issue and the theoretical foundations of the Human Rights-Based Approach, which recognises individuals living in poverty as rights-holders and States as duty-bearers with positive obligations to provide social benefits in their favour, this paper aims to assess the actual capacity of this approach to produce tangible improvements in the living conditions of the most vulnerable.
L’eradicazione della povertà costituisce una delle sfide più urgenti e complesse che la comunità internazionale è chiamata ad affrontare. Lungi dall'essere una mera questione economica, essa si configura come una problematica intrinsecamente connessa alla tutela dei diritti umani. Il presente elaborato, pertanto, si propone di analizzare la povertà alla luce del quadro giuridico elaborato in ambito delle Nazioni Unite, al fine di comprendere in che misura la questione possa essere interpretata da una prospettiva giuridica. Attraverso l’esame del Patto internazionale sui diritti economici, sociali e culturali e dei principali documenti elaborati dall’Organizzazione, si intende indagare la progressiva affermazione dell’idea secondo cui la povertà rappresenti una forma di negazione o di mancato adempimento dei diritti umani. L’analisi prenderà in considerazione le questioni teoriche che tale impostazione solleva: fino a che punto è corretto qualificare la povertà come una violazione dei diritti umani? Tutti i diritti sono ugualmente rilevanti ai fini di una tale qualificazione, oppure solo determinate categorie assumono un ruolo decisivo, e secondo quali criteri? Dopo aver delineato l’evoluzione storica della povertà come questione sociale e le basi teoriche dello Human Rights-Based Approach, che riconosce gli individui in condizione di indigenza come titolari di diritti soggettivi e gli Stati come titolari di obblighi positivi di garantire prestazioni sociali in loro favore, l’elaborato si propone di valutare la capacità effettiva di tale approccio di incidere sulle condizioni di vita delle persone più vulnerabili.
