This thesis examines the legal and institutional role of the European Union in the field of space activities, with particular focus on the evolution of its competence and its relationship with the European Space Agency (ESA). Starting from the international framework defined by space law—developed since the 1960s under the auspices of the United Nations and the COPUOS Committee—the study reconstructs the corpus iuris spatialis and the EU’s position within it, highlighting the limitations stemming from its nature as an international organization. The thesis explores the cooperation between the EU and ESA, formalized in the 2003 Framework Agreement, and analyzes the main programs and legal instruments adopted at the European level, culminating in the recognition of specific space competence under Article 189 of the Treaty on the Functioning of the European Union (TFEU). Special attention is given to the EU’s emerging role in the New Space Economy, its space strategy on security and defense, and Italy’s contribution to shaping European space governance. The study ultimately reflects on future challenges for a coherent, sustainable, and autonomous regulation of space activities in an evolving international context.
La presente tesi analizza il ruolo giuridico e istituzionale dell’Unione Europea nell’ambito delle attività spaziali, esaminando in particolare l’evoluzione della sua competenza in materia e il rapporto con l’Agenzia Spaziale Europea (ESA). A partire dal contesto internazionale definito dal diritto spaziale – sviluppatosi a partire dagli anni ’60 sotto l’egida delle Nazioni Unite e del Comitato COPUOS – si ricostruisce il corpus iuris spatialis e la posizione dell’UE rispetto a esso, evidenziando le limitazioni derivanti dalla sua natura di organizzazione internazionale. La tesi approfondisce inoltre la cooperazione tra UE ed ESA, formalizzata con l’Accordo Quadro del 2003, e analizza i principali programmi e strumenti normativi adottati in ambito europeo, fino al consolidamento della competenza spaziale con il Trattato di Lisbona (art. 189 TFUE). Particolare attenzione è riservata al ruolo emergente dell’UE nella nuova Space Economy, alla strategia spaziale in materia di sicurezza e difesa, e al contributo dell’Italia nel processo di definizione della governance spaziale europea. L’elaborato mette infine in luce le sfide future per una regolamentazione coerente, sostenibile e autonoma delle attività spaziali in un contesto internazionale in rapida evoluzione.
