Light pollution represents a form of environmental degradation that is still underestimated, despite its negative effects on ecosystems, human health, energy consumption, and astronomical observation. This thesis analyzes the phenomenon from multiple perspectives, with particular attention to legal aspects and the lack of comprehensive national legislation in Italy. After a technical and scientific examination of the sources and impacts of artificial light at night, the thesis delves into regulatory developments at the regional level, focusing on Veneto Regional Law No. 17/2009, examining its effectiveness and limitations. The thesis also explores the fundamental principles of environmental law—precaution, prevention, responsibility, and sustainable development—applied to the protection of the night sky. The work is rounded out with a reflection on the role of case law and a proposed national law. The aim is to highlight the need for an integrated strategy to contain light pollution, promoting a new culture of darkness as a resource to be protected.
L’inquinamento luminoso rappresenta una forma di degrado ambientale ancora troppo sottovalutata, nonostante i suoi effetti negativi su ecosistemi, salute umana, consumo energetico e osservazione astronomica. La presente tesi analizza il fenomeno sotto molteplici profili, con particolare attenzione agli aspetti giuridici e alla carenza di una normativa nazionale organica in Italia. Dopo una disamina tecnico-scientifica delle fonti e degli impatti della luce artificiale notturna, l’elaborato approfondisce l’evoluzione normativa a livello regionale, con un focus sulla Legge Regionale Veneto n. 17/2009, esaminandone efficacia e limiti. La tesi esplora inoltre i principi fondamentali del diritto ambientale — precauzione, prevenzione, responsabilità e sviluppo sostenibile — applicati al contesto della tutela del cielo notturno. Completano il lavoro una riflessione sul ruolo della giurisprudenza e una proposta di legge nazionale. L’obiettivo è evidenziare la necessità di una strategia integrata per il contenimento dell’inquinamento luminoso, promuovendo una nuova cultura del buio come risorsa da proteggere.
