The research examines the procedural aspects of the revocatory action, with particular focus on the effects, foundation, and legal nature of the judgment granting the claim. Once its constitutive nature is established, the analysis addresses issues such as compensatory revocatory action, the enforceability of any condemnatory provisions within a constitutive judgment, and the admissibility of the revocatory exception. Attention is also given to matters concerning passive standing, with reference to the procedural roles of the third-party transferee, the sub-transferee, and the debtor. The research concludes with an analysis of litisconsortial issues arising in the context of legal institutions such as marital community property, family asset funds, trusts, and destination deeds under article 2645-ter of the Italian Civil Code.

Abstract
The research examines the procedural aspects of the revocatory action, with particular focus on the effects, foundation, and legal nature of the judgment granting the claim. Once its constitutive nature is established, the analysis addresses issues such as compensatory revocatory action, the enforceability of any condemnatory provisions within a constitutive judgment, and the admissibility of the revocatory exception. Attention is also given to matters concerning passive standing, with reference to the procedural roles of the third-party transferee, the sub-transferee, and the debtor. The research concludes with an analysis of litisconsortial issues arising in the context of legal institutions such as marital community property, family asset funds, trusts, and destination deeds under article 2645-ter of the Italian Civil Code.| File | Dimensione | Formato | |
