The incarceration of women with children is a very complex and delicate issue to address. When discussing detained motherhood, two fundamental rights come into conflict: on the one hand, the right of an imprisoned mother to maintain an emotional and caring relationship with her child, and on the other, the child’s right to live a free, healthy childhood that meets his or her developmental needs. The need to detain mothers and children is addressed by national and supranational regulations, which seek to balance these two rights as much as possible. The aim of these laws, as well as the long-term goal of the prison system, is to move beyond the use of traditional incarceration both for detained mothers and for their children, humanizing punishment and emphasizing the rehabilitation of the convicted person rather than mere penalization as in the past. The objective is therefore to create facilities that are not comparable to prisons but are instead as close as possible to a healthy, family-like environment.
La detenzione femminile con prole risulta essere un tema molto complesso e delicato da affrontare. Quando si parla di maternità detenuta si scontrano due diritti fondamentali: quello della madre detenuta a mantenere un rapporto affettivo e di cura con il proprio bimbo da un lato e, dall'altro, il diritto del minore a vivere un'infanzia libera, sana e conforme ai propri bisogni evolutivi. L'esigenza di detenere madri e figli è affrontata dalle normative nazionali e sovranazionali, che cercano di bilanciare il più possibile i due diritti sopra citati. L'obiettivo di queste leggi e la finalità a lungo termine del sistema carcerario è quello di superare il carcere sia per le madri detenute, sia per i loro figli, umanizzando la pena e ponendo l'accento sulla rieducazione del condannato, non sulla mera punizione come avveniva nel passato. Si punta infatti a creare delle strutture che non siano assimilate al carcere ma siano il più possibile riconducibili ad un ambiente sano e familiare.
