Il Regolamento Macchine Europeo 2023/1230: novità e confronto con la direttiva precedente

Machinery safety in the European market is ensured by a harmonized European regulatory framework based on the Machinery Directive 2006/42/EC. With the introduction of new technologies, such as Artificial Intelligence (AI), the Directive quickly became obsolete, creating a regulatory vacuum. This necessitated the issuance of an updated version, the Machinery Regulation 2023/1230, intended to replace it. The main objective of this paper is to compare the old Machinery Directive with the new Machinery Regulation, highlighting the main differences and innovations introduced by the new legislative text, while also focusing on the practical implications for manufacturers and users.

La sicurezza dei macchinari nel mercato europeo è garantita tramite un quadro normativo europeo armonizzato, basato sulla Direttiva Macchinine 2006/42/CE. Con l'introduzione di nuove tecnologie, come l'Intelligenza Artificiale (AI), la Direttiva è diventata rapidamente obsoleta ed ha creato un vuoto normativo, che ha reso necessaria l'emanazione di un aggiornamento, ovvero il Regolamento Macchine 2023/1230, destinato a sostituirla. L'obiettivo principale di questo elaborato è quello di confrontare la vecchia Direttiva Macchine con il nuovo Regolamento Macchine, esponendo le differenze principali e le novità introdotte dal nuovo testo di legge, concentrandosi anche sulle implicazioni pratiche per fabbricanti ed utilizzatori. ​
