This paper analyzes the role of informed consent as an inseparable synthesis between the right to self-determination and the right to health, exploring the evolution of medical liability toward the definitive overcoming of the paternalistic model. Through an examination of the Balduzzi Decree and the Gelli-Bianco Law, the investigation reconstructs the evolution of criminal negligence and the consequences of arbitrary medical treatment. The study then goes beyond the confines of individual consent to address the critical aspects of compulsory medical treatment (TSO), mandatory vaccinations, and clinical trials, outlining how the legal system balances individual decision-making autonomy with the needs of public health and scientific progress.
Il presente elaborato analizza il ruolo del consenso informato quale sintesi inscindibile tra il diritto all’autodeterminazione e quello alla salute, esplorando l’evoluzione della responsabilità medica verso il definitivo superamento del modello paternalistico. Attraverso l’esame del Decreto Balduzzi e della Legge Gelli-Bianco, l'indagine ricostruisce l'evoluzione della colpa penale e le conseguenze del trattamento medico arbitrario. Lo studio si spinge poi oltre i confini del consenso individuale per affrontare i profili critici del TSO, delle vaccinazioni obbligatorie e della sperimentazione clinica, delineando come l'ordinamento bilanci l’autonomia decisionale individuale con le esigenze della salute pubblica e il progresso scientifico.
