This thesis focuses on the analysis of workplace discrimination, in some of its various forms. Specifically, the thesis explores the evolution of harassment within the working environment, aiming to assess whether the current regulatory framework successfully guarantees effective protection to the victims. Beginning with a general overview of the phenomenon, which takes into consideration the social and cultural contexts in which said conducts take place, the study proceeds to analyze the legislation on both national and supranational levels (with particular consideration for the ILO Convention no. 190/2019). Following a brief comparative analysis of the phenomenon across some of the European States, the paper investigates the protection mechanisms currently available to victims. This section, which is crucial to the discussion, concludes by highlighting the strengths and, above all, the critical shortcomings of the framework, considering the multifaceted nature that characterizes workplace harassment. Furthermore, mention will be made of the social and cultural developments that may influence this legal issue, shedding light on how these factors can prove decisive in achieving protection that is truly real and effective.
