Retributionism, both in its historical evolution and in the contemporary world, presents itself as a doctrinal paradigm as repudiated as it is indispensable. It is true that, from archaic Greece up to the recent debate on re-education, passing through Hobbes, Beccaria, Kant and Hegel, retributionism itself has not failed to reveal contradictions and profound shifts. However, resuming the position of the Paduan school referring to Bettiol, it seems undoubted that even today the punishment maintains an innate retributive vocation in its very essence, without detracting from the re-educational potential of its execution. The main aim of this work is, therefore, to free the debate on retributionism from any ideological preconceptions and to explore the question of the legal nature of the penalty in its entirety and clarity.

Il retribuzionismo, sia nella sua evoluzione storica che nella contemporaneità, si presenta come un paradigma dottrinario tanto ripudiato quanto irrinunciabile. È pur vero che, dalla Grecia arcaica fino al recente dibattito sulla rieducazione, passando per Hobbes, Beccaria, Kant ed Hegel, lo stesso retribuzionismo non ha mancato di svelare contraddizioni e profondi avvicendamenti. Tuttavia, riprendendo la posizione della scuola padovana facente riferimento al Bettiol, pare indubbio che ancora oggi la pena mantenga un’innata vocazione retributiva nella sua stessa essenza, senza nulla togliere alla potenzialità rieducativa della sua esecuzione. L’obiettivo dell’elaborato è, quindi, liberare il dibatto sul retribuzionismo da ogni preconcetto ideologico e approfondire la questione della natura giuridica della pena nella sua integralità e nitidezza.
