L’affido sine-die e la tutela del minore. La complessità di un progetto a lungo termine.

Family custody is one of the projects that characterize minors in charge of the Protection and Care of minors area, as the latter is actually implemented when the minor is temporarily in a context without a suitable family environment and where necessary to act to allow it to grow in the most appropriate way. This temporary instrument has as its aim the return of the minor to the family of origin, bypassed however by a practice recently implemented by the services: that is sine-die foster care. On this occasion, the minor finds himself living in a situation characterized by a double family for an indefinite period. These will be the subjects involved in the foster care project, thus taking into account the psychological aspects, the risk and protection factors present in the minor who is involved in a double family reality and the difficulties that biological and foster parents may find themselves facing: internal difficulties such as emotions and experiences, and difficulties related to the more concrete aspects of everyday life. Then a focus on the psychological implications that emerge, given the long-term project, in the minor and in the two families and on the lack of legal framework.

L'affido familiare è uno dei progetti che caratterizzano i minori in carico nell'area di Protezione e Cura minori, in quanto quest'ultimo viene di fatto attuato qualora il minore si trovi temporaneamente in un contesto privo di un ambiente familiare idoneo e dove è necessario agire per permettergli di crescere nel modo più adeguato. Tale strumento temporaneo ha come fine il rientro del minore nella famiglia d'origine, bypassato però da una pratica ultimamente attuata dai servizi: ovvero l'affido sine-die. In tale occasione il minore si trova a vivere una realtà caratterizzata da una doppia famiglia per un periodo indefinito. Si tratterà dei soggetti coinvolti nel progetto di affido, tenendo conto quindi degli aspetti psicologici, dei fattori di rischio e protezione presenti nel minore che si trova coinvolto in una doppia realtà familiare e le difficoltà che possono trovarsi ad affrontare i genitori biologici e quelli affidatari: difficoltà interne quali, emozioni e vissuti, e difficoltà legate agli aspetti più concreti della quotidianità. Quindi un focus sulle implicazioni psicologiche che emergono, dato il progetto a lungo termine, nel minore e nelle due famiglie e sulla mancanza della cornice giuridica.
