La Responsabilità della Pubblica Amministrazione: analisi degli sviluppi giurisprudenziali in merito alla tutela dell'affidamento del cittadino

This study will have as its object an analysis of the jurisprudential disputes between the Corte di Cassazione and the Consiglio di Stato regarding the responsibility of the public administration in the context of the protection of the trust citizens have in it. The discussion will highlight the problems inherent to the exercise the power of the public Authority and the nature of the non-guilty trust, focusing mainly on the problem inherent to the identification of the competent judge in the matter.

Il presente studio avrà ad oggetto un'analisi delle diatribe giurisprudenziali tra Corte di Cassazione e Consiglio di Stato in merito alla responsabilità della pubblica amministrazione nell'ambito della tutela dell'affidamento del cittadino. La trattazione metterà in luce le problematiche inerenti all'esercizio del potere e alla natura dell'affidamento incolpevole, soffermandosi principalmente sul problema inerente all'individuazione del giudice competente in materia.
