The thesis explores the issue of discrimination in the workplace based on disability, contextualizing it in the light of recent Italian and European legislative developments, through a detailed analysis of the legislation.The research defines the different forms of discrimination and examines their international regulatory framework, with particular reference to the UN Convention on the Rights of Persons with Disabilities. Significant case law cases are discussed to illustrate the discriminatory practice in Europe, including issues related to invisible disability and indirect discrimination of caregivers. Finally, the thesis proposes legislative and political measures to combat discrimination, highlighting the crucial role of trade union organisations and public authorities. The conclusion summarizes the results and offers reflections and proposals for greater protection of people with disabilities in European working environments.
La tesi esplora il tema della discriminazione sul luogo di lavoro basata sulla disabilità, contestualizzandolo alla luce delle recenti evoluzioni normative italiane ed europee, attraverso un'analisi dettagliata della legislazione. La ricerca definisce le diverse forme di discriminazione e ne esamina il quadro normativo internazionale, con particolare riferimento alla Convenzione delle Nazioni Unite sui diritti delle persone con disabilità. Vengono discussi casi giurisprudenziali significativi per illustrare la pratica discriminatoria in Europa, inclusi i problemi legati alla disabilità invisibile e alla discriminazione indiretta dei caregiver. Infine, la tesi propone misure legislative e politiche per contrastare la discriminazione, evidenziando il ruolo cruciale delle organizzazioni sindacali e delle autorità pubbliche. La conclusione sintetizza i risultati e offre riflessioni e proposte per una maggiore tutela delle persone con disabilità nei contesti lavorativi europei.
