Self-preferencing is a phenomenon that, in recent years, especially with digital markets, has gained significant relevance and become the subject of widespread debate. It refers to the practice whereby platforms (particularly digital ones) favor their own products or services over those of third parties, leveraging their dominant position. This thesis is divided into three chapters. The first provides a general overview of self-preferencing, focusing on the mechanisms through which it is exercised and the effects it has on markets and, consequently, on consumers. The second chapter is dedicated to regulatory approaches, comparing the ex-post enforcement of Article 102 TFEU with the ex-ante approach introduced by the Digital Markets Act (DMA); it also includes a global perspective, examining regulatory responses in countries as the USA, highlighting the differences and developments compared to the European framework. Lastly, the third chapter presents concrete cases and empirical data, with a particular focus on studies related to Amazon Marketplace, where an innovative measurement approach is adopted. The thesis concludes by emphasizing the need for a flexible, data driven regulatory framework capable of distinguishing between abusive conduct and efficient integration, while also considering the potential for pro-competitive effects.
Il self-preferencing è una fenomeno che nel corso degli ultimi anni, specialmente nell’ambito dei mercati digitali, ha assunto una notevole rilevanza, ed è stato al centro di numerosi dibattiti. Esso è una pratica attraverso cui le piattaforme (specialmente quelle digitali) favoriscono i propri prodotti o servizi rispetto a quelli offerti da terze parti, utilizzando la propria posizione dominante. Il presente elaborato si suddivide in 3 capitoli: il primo permette di esplorare ed avere una panoramica generale sul self-preferencing, concentrandosi sui meccanismi con cui viene esercitato e gli effetti che si riflettono sui mercati e di conseguenza sui consumatori. A seguire, il secondo capitolo è dedicato agli approcci normativi, confrontando quello ex-ante dettato dall’art.102 TFUE ed a quello ex-post introdotto dal DMA; inoltre si darà una panoramica mondiale, facendo riferimento alle regolazioni adottate nel caso degli USA, osservando le diversità e le conoscenze rispetto all’Europa. Infine, nel terzo ed ultimo capitolo verranno trattati casi concreti e dati empirici, con un focus rivolto agli studi su Amazon Marketplace, dove verrà utilizzato un approccio di misurazione innovativo. La tesi si conclude riflettendo sulla necessità di una regolazione flessibile, orientata ai dati, capace di distinguere tra abuso e integrazione efficiente, mostrando la possibilità di avere anche vantaggi procompetitivi.
