This thesis analyzes the principle of non-discrimination on religious grounds within the European workplace, with particular reference to the wearing of the Islamic veil by Muslim female workers. After providing a legal framework for the protection of religious freedom in the European Union and in Italy, the study examines key rulings from the Court of Justice of the European Union and the European Court of Human Rights. Special focus is placed on landmark cases such as Achbita, Bougnaoui, WABE, and Müller, highlighting the tensions between freedom of enterprise and individual rights. The thesis concludes by emphasizing the risks of social exclusion resulting from corporate neutrality policies that are not adequately balanced, and it proposes more inclusive interpretative approaches.
Questo elaborato analizza il principio di non discriminazione religiosa nel contesto lavorativo europeo, con particolare riferimento all’uso del velo islamico da parte delle lavoratrici musulmane. Dopo un inquadramento normativo della tutela della libertà religiosa nell’Unione Europea e in Italia, si esaminano le principali pronunce della Corte di Giustizia dell’UE e della Corte Europea dei Diritti dell’Uomo. L’attenzione si concentra su casi emblematici come Achbita, Bougnaoui, WABE e Müller, mettendo in evidenza le tensioni tra libertà d’impresa e diritti individuali. La tesi conclude sottolineando i rischi di esclusione sociale derivanti da politiche aziendali di neutralità non bilanciate e propone linee interpretative più inclusive.
