This thesis analyzes and explores the phenomenon of forced and early marriages in the Italian context, through the emblematic case of Saman Abbas. A multidisciplinary approach, combining legal, social, and cultural perspectives, was employed. The first chapter provides a theoretical and critical overview, defining the concepts of forced and early marriage, and presenting their characteristics, specificities, comparisons, and distinctions. It also examines the dynamics and structural causes that contribute to the phenomenon’s persistence, including family, community, religious, and social pressures, gender disparities and inequalities, as well as economic and migration-related issues. The analysis also highlights the serious repercussions on the victims’ physical and psychological health, development, and capacity for self-determination. The chapter concludes with an overview of the Italian legal framework for combating forced and early marriages, also referencing the main UN conventions on the subject ratified by Italy. The second chapter focuses on the case of Saman Abbas, a Pakistani teenager who was killed in Italy after refusing to marry. The chapter presents her biographical profile, family, and cultural background. Through an analysis of the dynamics surrounding her refusal, it retraces the events that led to the tragic outcome and examines the media and social impact, contributing to public and academic debate on the issue. The third and final chapter is dedicated to prevention and awareness strategies implemented in Italy, covering both local and international initiatives. It also analyzes the challenges in addressing this often-hidden phenomenon and outlines future prospects and objectives for a more effective and integrated response. The thesis aims to raise awareness of the phenomenon, reflecting on the delicate balance between protecting individual rights, respecting cultural contexts, and enforcing the law, while emphasizing the importance of tools designed to prevent further tragedies.
La presente tesi analizza e approfondisce il fenomeno dei matrimoni forzati e precoci in riferimento al contesto italiano, attraverso il caso emblematico di Saman Abbas. È stato utilizzato un approccio multidisciplinare che unisce prospettive giuridiche, sociali e culturali. Il primo capitolo offre una panoramica teorica e critica, definendo i concetti di matrimonio forzato e precoce, presentando caratteristiche, specificità, confronti e distinzioni. Inoltre, esplora le dinamiche e cause strutturali che ne alimentano la diffusione, tra cui pressioni familiari, comunitarie, religiose, sociali, disparità e disuguaglianze di genere, questioni economiche e migratorie. L’analisi mette in luce anche le gravi ripercussioni e conseguenze sulla salute fisica, psicologica, sullo sviluppo e sull’autodeterminazione delle vittime. Il primo capitolo si conclude con la presentazione del quadro normativo italiano per il contrasto ai matrimoni forzati e precoci, facendo riferimento anche alle principali Convenzioni ONU in merito, ratificate dall’Italia. Il secondo capitolo si concentra sul caso Saman Abbas, adolescente pakistana uccisa in Italia dopo aver rifiutato un matrimonio. Viene presentato il profilo biografico della vittima, il contesto familiare e culturale di appartenenza. Inoltre, attraverso l’analisi delle dinamiche che hanno caratterizzato il suo rifiuto al matrimonio, il capitolo ripercorre gli eventi che hanno portato al tragico epilogo, e presenta l’impatto mediatico e sociale, contribuendo a stimolare il dibattito pubblico e accademico sul tema. Il terzo ed ultimo capitolo è dedicato alle strategie di prevenzione e sensibilizzazione attuate in Italia tra interventi locali ed internazionali. Analizza anche le difficoltà nel contrastare tale fenomeno, spesso sommerso, e le prospettive ed obiettivi futuri per una risposta più efficace ed integrata. L’elaborato intende contribuire a dare una maggiore consapevolezza del fenomeno, riflettendo sul delicato equilibrio tra tutela dei diritti individuali, rispetto culturale e applicazione della legge, sottolineando l’importanza degli strumenti volti a prevenire nuove tragedie.
