Giustizia Trasformativa come strumento di cura e responsabilizzazione attraverso un caso studio.

In this thesis we will try to explore the practices of transformative justice, a method which, in cases of gender violence, aims to make the person who inflicted the damage responsible and to carefully support the survivor, rather than resorting to punitive and state responses. The first part of the research will delve into the abolitionist thought of prisons and the punitive system, to highlight the theoretical bases from which transformative justice takes impetus in proposing new ways of managing conflict and damage. Subsequently, the European case of Giusi Palomba and his text The alternative plot will be analyzed as a narrative and political example of a community response to gender violence. Finally, the thesis will include some interviews with a local anti-harassment collective in Padua, engaged in anti-prison and transfeminist practices, to investigate how abolitionist and transformative principles are expressed in the reality of contemporary movements. The goal is to answer the question: how to build transformative justice outside punitive institutions, through community practices that aim not only to define, but to build justice?

In questo elaborato di tesi si cercherà di esplorare le pratiche di giustizia trasformativa, un metodo che, nei casi di violenza di genere, mira a responsabilizzare la persona che ha inferto il danno e a sostenere con cura lx sopravvissutə, piuttosto che ricorrere a risposte punitive e statali. La prima parte della ricerca approfondirà il pensiero abolizionista delle carceri e del sistema punitivo, per evidenziare le basi teoriche da cui la giustizia trasformativa prende slancio nel proporre nuove modalità di gestione del conflitto e del danno. Successivamente, verrà analizzato il caso europeo di Giusi Palomba e il suo testo La trama alternativa, come esempio narrativo e politico di risposta comunitaria alla violenza di genere. Infine, l’elaborato includerà alcune interviste a un collettivo locale antimolestie di Padova, impegnato in pratiche anticarcerarie e transfemministe, per indagare come i principi abolizionisti e trasformativi vengano declinati nella realtà dei movimenti contemporanei. L’obiettivo è rispondere alla domanda: come costruire giustizia trasformativa fuori dalle istituzioni punitive, attraverso pratiche comunitarie che mirano non solo a definire, ma a costruire giustizia?
