The paper explores the impact of cognitive biases in forensic science, with a focus on forensic psychopathology and the assessment of imputability. The vulnerabilities of experts and the intrinsic limitations of the discipline that influence the agreement between raters are analyzed. Some of the most influential cognitive biases are examined in depth: confirmation bias, adversarial allegiance and the influence of irrelevant contextual information.These will be discussed starting from the 'Hierarchy of Expert Performance' (HEP) model by Itiel Dror, then mitigation strategies and guidelines to improve the reliability and objectivity of expert assessments.
L’elaborato esplora l'impatto dei bias cognitivi nelle scienze forensi, con un focus sulla psicopatologia forense e la valutazione dell'imputabilità. Vengono analizzate le vulnerabilità degli esperti e le limitazioni intrinseche della disciplina che influenzano la concordanza tra valutatori. Sono approfonditi alcuni tra i più influenti bias cognitivi: il confirmation bias, l’adversarial allegiance e l’influenza delle informazioni contestuali irrilevanti. Questi saranno discussi a partire dal modello ‘Hierarchy of Expert Performance’ (HEP) di Itiel Dror, successivamente vengono poste in esame strategie di mitigazione e linee guida per migliorare l'affidabilità e l'oggettività delle valutazioni peritali.
